These Terms and Conditions govern your use of getpromoted.in and your purchase or use of services provided by GetPromoted. They are intended to create a clear understanding between GetPromoted and each website visitor, prospective client, client, authorized representative, vendor or other person who interacts with us.
GetPromoted provides website design, website development, ecommerce development, website redesign, website personalization, search engine optimization, digital marketing, content-related support and associated technical services. Specific project scope, pricing, timelines and deliverables may be stated in a quotation, proposal, order confirmation, statement of work or separate written agreement.
Clear requirements, timely approvals and open communication help every digital project move smoothly from planning to launch.
GetPromoted Project Commitment
By using this website, submitting an enquiry, accepting a proposal, paying an invoice or instructing us to begin work, you confirm that you have read and accepted the terms that apply to the relevant interaction. If a signed agreement or accepted proposal conflicts with these general Terms, the more specific written document will control for that project.
You may use our website to learn about GetPromoted, review our services, contact our team and request business information. You agree to use the website lawfully and in a way that does not harm the website, our systems, our reputation, our team or another user.
You must not attempt to gain unauthorized access, introduce malicious code, interfere with website performance, test security without written permission, scrape information through abusive automated methods, impersonate another person, submit false enquiries or use our website for unlawful, fraudulent or misleading purposes.
Website information is provided for general business guidance. We aim to keep service information useful and accurate, but website content may not describe every project condition. A service page, case study, estimate, article or general statement does not create a binding project commitment unless it is included in an accepted written proposal or agreement.
Before work begins, GetPromoted may issue a quotation, proposal, scope document or invoice describing the selected service. The document may identify deliverables, assumptions, exclusions, estimated timelines, revision limits, fees, payment stages and client responsibilities. A proposal remains subject to its stated validity period and may be revised if requirements, costs or availability change before acceptance.
Only items clearly included in the agreed scope are part of the project. Services such as copywriting, photography, paid plugins, premium themes, hosting, domain registration, advertising spend, product entry, data migration, third-party integrations, maintenance, legal drafting or ongoing SEO are excluded unless specifically included.
Estimates are based on the information available when they are prepared. If technical investigation reveals hidden issues, incompatible systems, missing access, damaged data, security problems or requirements that were not disclosed, we will explain the issue and may recommend a revised scope, timeline or fee before continuing the affected work.
Clients are responsible for providing complete and accurate requirements, timely feedback, content, logos, images, product data, legal notices, credentials and approvals needed for the project. The client should nominate an authorized contact who can provide instructions and approve work on behalf of the business.
The client confirms that materials supplied to GetPromoted may lawfully be used for the project and do not infringe copyright, trademark, privacy, publicity or other rights. The client is responsible for checking factual claims, prices, product descriptions, terms, privacy notices, regulatory disclosures and industry-specific statements before publication.
Clients must maintain secure backups of important business data unless backup services are expressly included. Credentials should be shared through an agreed secure method where possible. The client should create limited-access accounts, protect passwords and remove unnecessary access when work is complete.
Project timelines are reasonable estimates unless a written agreement expressly guarantees a date. Delivery depends on project complexity, technical conditions, third-party services, client response time and timely receipt of required materials and payments.
If content, access, feedback or approval is delayed, related milestones may move accordingly. GetPromoted is not responsible for delays caused by incomplete instructions, repeated changes, unavailable client representatives, third-party platforms, hosting providers, payment gateways, app stores, search engines or events outside our reasonable control.
Clients should review drafts, staging websites and deliverables carefully. Approval by email, message, meeting record, payment or instruction to proceed may be treated as acceptance of the relevant stage. Issues reported after approval may be handled as a revision, support request or new scope depending on their nature.
Fees and payment stages are stated in the relevant quotation, proposal or invoice. Unless stated otherwise, applicable taxes, third-party charges, advertising budgets, domain fees, hosting fees, software subscriptions, premium licenses and payment-processing costs are separate from GetPromoted service fees.
Work may begin after the required advance payment and receipt of essential project information. Milestone payments must be made when due. We may pause work, withhold final files, delay launch, restrict support or suspend services where an invoice remains unpaid after reasonable notice.
Deposits and payments cover reserved time, discovery, planning and work already performed. Refund eligibility, if any, depends on the accepted proposal, the stage reached, committed third-party costs and work completed. Third-party purchases, completed milestones and approved deliverables are generally non-refundable except where required by applicable law or expressly agreed in writing.
Reasonable revisions may be included as stated in the project proposal. A revision adjusts agreed work; it does not introduce a new page, feature, design direction, integration, content category or business requirement.
Requests outside the agreed scope may require a separate estimate, additional payment and revised timeline. We will normally identify a significant scope change before performing the extra work. Small requests may be grouped and quoted together to keep project administration practical.
If a client changes the approved direction or asks us to recreate completed work, earlier time and costs remain payable. Where instructions conflict, we may pause the affected task until the authorized client representative confirms the final direction.
GetPromoted retains ownership of its pre-existing methods, internal tools, reusable code, frameworks, processes, templates, know-how and materials developed independently of a specific client project. Third-party software, fonts, images, themes, plugins and platforms remain subject to their respective owners’ licenses.
Once all fees for the relevant deliverables are paid, the client receives the ownership or usage rights described in the accepted proposal. Where the proposal does not specify otherwise, the client may use final custom deliverables for its business, while GetPromoted retains rights in pre-existing and reusable components.
Drafts, unused concepts, internal working files and rejected alternatives are not transferred unless expressly agreed. GetPromoted may refer to publicly launched work in its portfolio or proposals only where this is permitted by the project terms, client instructions and confidentiality commitments.
Digital projects often depend on third parties such as hosting companies, domain registrars, payment gateways, analytics tools, advertising platforms, search engines, social networks, email providers, plugins, APIs and software vendors. Their products are governed by separate terms, privacy policies, pricing and availability.
GetPromoted does not control third-party uptime, policy changes, approval decisions, account suspensions, price increases, compatibility changes, security incidents or discontinued features. We may assist with setup or troubleshooting, but cannot guarantee a third party’s continued operation or acceptance.
Unless agreed otherwise, the client should hold important domain, hosting, analytics, advertising and platform accounts in its own legal name and maintain valid payment details. The client remains responsible for renewals and compliance with third-party rules.
GetPromoted provides professional services using reasonable skill and care. However, digital results depend on many factors outside our control, including competition, market conditions, client offers, pricing, content quality, website history, technical limitations, advertising budgets, user behaviour and changes made by search engines or platforms.
SEO rankings, traffic, enquiries, sales, advertising performance, platform approval and business revenue are not guaranteed unless a specific measurable commitment is expressly included in writing. Forecasts, examples, audits and case studies illustrate possibilities or past experience and should not be treated as promises of identical results.
Search engines and advertising platforms may change algorithms, policies and reporting methods without notice. GetPromoted may adjust strategy in response, but is not responsible for losses caused solely by an external platform change, pre-existing penalty, competitor action or client activity outside our agreed control.
We test websites using the browsers, devices and environments reasonably relevant to the agreed scope. Perfect consistency across every historic browser, screen, extension, network or third-party device cannot be guaranteed. Support for unusual or legacy environments must be agreed separately.
Either party may request cancellation in writing. The client remains responsible for work completed, approved milestones, reserved resources, non-cancellable commitments and third-party costs incurred up to the effective cancellation date.
GetPromoted may pause or terminate work where payments remain overdue, required cooperation is repeatedly unavailable, instructions require unlawful or misleading conduct, abusive behaviour occurs, security is threatened, third-party rules would be violated or continuing the project becomes impractical for reasons outside our reasonable control.
After termination and settlement of outstanding amounts, we will provide completed deliverables or access to the extent required by the accepted agreement and technically available. Migration, handover, data export or extended transition support may be chargeable unless included in the original scope.
To the maximum extent permitted by applicable law, GetPromoted will not be liable for indirect, incidental, special or consequential losses, including lost profits, lost opportunities, loss of goodwill or loss of data, arising from website use or services. Nothing in these Terms excludes liability that cannot lawfully be excluded.
Where liability arises in connection with a paid service, our total liability will not exceed the fees paid to GetPromoted for the specific service giving rise to the claim, unless a different limit is stated in a signed agreement or applicable law requires otherwise.
The client agrees to be responsible for claims arising from materials, instructions, products, statements or data supplied by the client; the client’s unlawful use of deliverables; infringement caused by client-provided content; or failure to comply with applicable laws, platform terms or third-party rights.
Each party should use reasonable care to protect confidential business, technical and commercial information received through a project. Confidential information may be used for project delivery, administration, support, legal compliance and other purposes permitted by the relevant agreement.
Personal information is handled according to our Privacy Policy. Clients that provide personal data for processing remain responsible for having an appropriate legal basis, giving required notices and issuing lawful instructions for their own business activities.
Neither party will be responsible for delay or failure caused by events reasonably beyond its control, including natural disasters, severe weather, fire, epidemic, war, civil disturbance, government action, internet failure, power outage, cyberattack, labour disruption or widespread failure of a critical third-party service.
The affected party should communicate the issue where practical and take reasonable steps to reduce disruption. Timelines may be extended for the duration and impact of the event.
These Terms are governed by the laws of India. The parties should first attempt to resolve concerns through good-faith discussion. Subject to applicable law and any written dispute-resolution agreement, courts with jurisdiction in Gurgaon, Haryana will have jurisdiction over disputes connected with these Terms or our services.
If any provision is found invalid or unenforceable, the remaining provisions will continue to apply. A delay in enforcing a right does not waive that right. These Terms, together with an accepted proposal, invoice, statement of work and related written agreement, form the applicable understanding for the service.
We may update these Terms when our services, business processes, technology or legal obligations change. The revised version will be published on this page with an updated date. Changes will apply prospectively unless otherwise required by law or agreed in writing.
